1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Stratamap website at stratamap.io and our 3D map generation services (collectively, the "Services"). Stratamap is operated by Stratamap Limited, a company registered in New Zealand (NZBN: 9429051730376). Please read these Terms carefully before using our Services.

In these Terms, "we," "us," and "our" refer to Stratamap. "You" and "your" refer to you, the individual user of our Services.

2. Acceptance of Terms

By creating an account, subscribing, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, you must not use our Services.

You must be at least 13 years old to use our Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), your parent or guardian must agree to these Terms on your behalf.

3. Description of Services

Stratamap provides a 3D map generation platform that allows you to:

  • Design custom maps by selecting geographic areas, layers, and styling options
  • Purchase map export packs or subscribe to a plan to generate 3D meshes from your designs
  • Export generated 3D mesh files for 3D printing or other uses
  • Share projects with others via share links

We may modify, suspend, or discontinue any part of the Services at any time. If we discontinue the map generation service entirely, we will provide at least 90 days' notice, cancel active subscriptions and refund the current billing period, and refund the purchase price of any unused export pack map exports that have not yet expired on a pro-rata basis. For other changes, we will endeavour to provide reasonable notice where practicable.

4. Account Terms

To use certain features of our Services, you must create an account. When you create an account, you agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us promptly if you suspect unauthorised access to your account
  • Accept responsibility for all activities that occur under your account

Each person may maintain only one account. You may not share your account with others, create multiple accounts for any reason (including to obtain additional promotional benefits such as free exports), or use another person's account without permission. We may use technical measures such as IP address monitoring to detect multiple account creation.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for more than 12 months. Where we determine that multiple accounts have been created by the same person, we may revoke exports obtained through those accounts and suspend or close the duplicate accounts without notice.

5. Purchases and Payment

Purchasing Map Exports

To generate and export 3D meshes from your designs, you may purchase map export packs or subscribe to our Pro plan:

  • Export Packs: One-time purchases of map exports for personal use. Map exports are valid for 3 years from the date of purchase.
  • Pro Subscription: Monthly plan that includes map exports each billing cycle under a commercial license, along with access to additional features.

Each generation uses one map export. Subscription map exports do not roll over between billing cycles. Unused subscription map exports expire at the end of each billing period. Export pack map exports are valid for 3 years from the date of purchase.

Purchased map exports are prepaid service entitlements, not stored value, gift cards, or vouchers. Map exports are non-redeemable for cash, have no monetary face value, and cannot be exchanged, traded, or transferred to any other person or account. Each map export entitles you solely to one map generation through the Services.

Promotional and Free Exports

We may offer free or promotional exports, such as a complimentary map on account creation. These are limited to one per person and are subject to the personal license terms. Promotional exports may not be obtained through creating multiple accounts, using disposable email addresses, or any other means of circumventing the intended limit. We reserve the right to revoke promotional exports obtained in violation of these Terms without notice.

License Terms

Your purchase type determines the license that applies to your exports:

Personal License (Export Packs): You receive a personal, non-exclusive, non-transferable, non-sublicensable license to use generated 3D mesh files for your own purposes, including personal projects, educational uses, and publishing photographs or videos of the files or prints made from them. You may modify the files, such as adding labels, mounting points, or other features. You may create physical 3D prints for personal use or to give as gifts. Commercial use is not permitted under this license.

Commercial License (Pro Subscription): In addition to all personal license rights, you may use exported files for commercial purposes, including selling printed map products and producing maps for clients. The commercial license applies to all your exports only while your Pro subscription is active. If your subscription ends, all exports revert to the personal license regardless of when they were generated. Commercial sales of physical map prints are subject to a monthly sales limit set out in your plan. If you need to sell more than your plan allows, contact us at support@stratamap.io and we can arrange a license to cover a higher volume.

Both licenses prohibit:

  • Redistributing or sublicensing the digital files to third parties
  • Uploading the files to file-sharing platforms or 3D model marketplaces
  • Industrial reproduction such as casting or moulding without prior written approval from Stratamap
  • Using the files, or any data derived from them, as training data for machine learning or artificial intelligence models

Cancellation and Expiration

You may cancel your subscription at any time through the subscription management portal. Upon cancellation, your subscription remains active until the end of the current billing period. You retain access to your remaining map exports and can continue to use the Services during this time. After the billing period ends, your subscription map exports expire and you will no longer be able to generate new files. Your previously downloaded files revert to the personal license. You may continue to use them for personal purposes but commercial use is no longer permitted.

Export pack map exports remain valid for their full validity period regardless of subscription status.

Regeneration Limits

Each export includes a limited number of regenerations. After export, you can adjust dimensions, heights, and print settings, then regenerate to produce updated files. Your outline selection, design, and drawn features are locked after export. Automatic regenerations triggered by our system do not count against this limit.

Payment Processing

All payments, including export pack purchases and recurring subscription charges, are processed by our third-party payment provider, Polar. By making a purchase or subscribing, you agree to Polar's terms of service and, for subscriptions, authorise recurring charges to your payment method. We do not store your full payment card details.

All prices are displayed in USD unless otherwise indicated. You are responsible for any applicable taxes, duties, or fees associated with your purchase.

Refunds

Our refund policy is detailed in our Refund Policy. Because our files are custom-generated digital products, fees are generally non-refundable once map exports have been used. See our Refund Policy for full details.

6. EU Consumer Rights

If you are a consumer in the European Union, you have the right to withdraw from a purchase or subscription within 14 days without giving a reason.

However, by purchasing map exports and using them to generate files, you expressly consent to immediate performance of the service and acknowledge that you lose your right of withdrawal for any map exports already used. If no map exports have been used, you retain your 14-day withdrawal right.

For export pack purchases, if you have not used any map exports from the pack, you may exercise your withdrawal right within 14 days of purchase for a full refund. For subscriptions, because features such as the commercial license and Store Link are available immediately, you acknowledge that performance begins upon activation and your withdrawal right is waived accordingly.

This does not affect your statutory rights if the service is faulty or not as described.

7. User Content

You retain ownership of designs and content you create using our Services ("User Content"). By using our Services, you grant us a worldwide, royalty-free, non-exclusive license to store, process, and display your User Content solely to provide the Services.

You represent that you have all necessary rights to your User Content, that it does not infringe third-party rights, and that it complies with applicable laws. We may remove User Content that violates these Terms without prior notice.

8. Generated Files

Generated 3D mesh files are provided under the license terms in Section 5. These files incorporate elevation data, land cover data, and other geographic information from third-party sources. You must comply with the attribution requirements in Section 9.

Download links are temporary and expire after 90 days. You may regenerate files within the limits of your export while the service remains available. Regenerated files may differ from previous versions due to updates in underlying geographic data sources.

9. Data Attributions

Our Services use geographic data from third-party sources that may require attribution:

  • OpenStreetMap: Licensed under the Open Database License (ODbL). Attribution: "© OpenStreetMap contributors".
  • Overture Maps Foundation: Subject to Overture Maps Foundation terms.
  • Elevation data: From government and open data sources with varying attribution requirements.

You are responsible for including any required attributions when displaying physical prints. This section will be updated as data sources change.

10. Share Links

You may create share links to let others view a snapshot of your project. Anyone with the link can view the project and claim a copy for their own editing. Share links remain active until you delete them or your account is terminated. You are responsible for managing who you share with.

11. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services to create content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the Services or servers connected to the Services
  • Use automated means (bots, scrapers, etc.) to access the Services without our permission
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Circumvent any usage limits, access controls, or security measures
  • Resell, sublicense, or redistribute the Services or generated files
  • Systematically download, scrape, mine, harvest, or extract data or content from the Services, whether manually or through automated means
  • Access or attempt to access projects, files, or data belonging to other users without their authorisation
  • Probe, scan, or test the vulnerability of the Services or any network connected to the Services, or breach any security or authentication measures
  • Place an unreasonable or disproportionately large load on our infrastructure, or engage in activity that degrades the performance or availability of the Services for other users
  • Use the Services to develop, train, or improve a competing product or service
  • Use the Services in any way that could damage our reputation or goodwill

12. Service Limitations

Our Services are subject to usage limits on active projects, map exports per billing cycle, regenerations, outline complexity, and file sizes. Current limits are displayed within the Services and may change over time.

We may impose additional limits to ensure fair use and service stability. If you exceed limits, we may restrict your access until you come into compliance.

13. Beta Features

We may offer features labelled "beta," "preview," or "early access." These features are experimental and provided without any warranty. Beta features may be unstable, change significantly, or be discontinued without notice. Data created using beta features may be lost.

By using beta features, you agree that we may contact you for feedback. For closed betas, you agree not to disclose details about the features without our permission.

14. Intellectual Property

Our Intellectual Property

The Services, including the website, software, design, text, graphics, logos, and other materials (excluding User Content and third-party data), are owned by or licensed to Stratamap and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal purposes, subject to these Terms. This license does not include the right to modify, copy, distribute, or create derivative works of our Services.

Third-Party Data

Geographic data from third-party sources (see Section 9) remains subject to those providers' intellectual property rights. We do not grant you rights to such data beyond what is necessary to use the Services.

Feedback

If you provide feedback, suggestions, or ideas about our Services, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.

15. Third-Party Services

Our Services rely on third-party providers for payment processing (Polar), authentication (Google, if selected), geographic data (see Section 9), and cloud infrastructure. Your use of these services is subject to their respective terms. We are not responsible for the availability or conduct of third-party services.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted or error-free, that geographic data will be accurate, or that generated files will be suitable for 3D printing. Printing results depend on factors outside our control, including your equipment, settings, and materials.

Some jurisdictions do not allow warranty exclusions, so the above may not fully apply to you.

17. Limitation of Liability

To the maximum extent permitted by law, Stratamap and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, cost of substitute services, or failed 3D prints.

Our total liability for all claims shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) NZD $100.

These limitations apply regardless of the theory of liability. Nothing in these Terms excludes liability for death, personal injury, or fraud caused by our negligence, or any liability that cannot be excluded by law.

18. Indemnification

You agree to indemnify and hold harmless Stratamap and its directors, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your User Content, your violation of these Terms or applicable law, or any dispute with a third party relating to the Services.

This indemnification obligation does not apply to the extent prohibited by the consumer protection laws of your jurisdiction.

19. Termination

You may close your account at any time by contacting support@stratamap.io. Closing your account does not entitle you to refunds, except where required by applicable consumer protection law or as described in our Refund Policy.

We may suspend or terminate your access at any time, including for Terms violations. We will endeavour to provide notice where practicable.

Upon termination, your access ceases immediately and you will lose access to your projects. Active subscriptions will be cancelled and remaining map exports will expire. If the Services are discontinued by us, unused purchased map exports will be refunded in accordance with Section 3 and our Refund Policy. We may delete your data after a reasonable period. Sections 5, 7, 9, 14, 16, 17, 18, 20, and 22 survive termination.

If your account is closed in good standing (without breach), your personal license to use files already downloaded prior to closure continues. Any commercial license rights end upon account closure. You will not be able to generate new files or access the Services after account closure.

20. Dispute Resolution

These Terms are governed by New Zealand law. Before formal proceedings, you agree to contact legal@stratamap.io to attempt informal resolution.

Disputes that cannot be resolved informally are subject to the exclusive jurisdiction of New Zealand courts. If you are a consumer with mandatory consumer protection rights, those statutory rights remain unaffected.

21. Changes to These Terms

We may update these Terms at any time. We will notify you of changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you by email or through the Services.

Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.

22. General Provisions

Entire Agreement: These Terms, our Privacy Policy, and Refund Policy constitute the entire agreement between you and Stratamap.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver: Our failure to enforce any provision does not waive that right.

Assignment: You may not assign these Terms without our consent. We may assign them without restriction.

Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or third-party service outages.

No Agency: Nothing in these Terms creates a partnership, joint venture, or employment relationship.
